1. Subject and applicability

These General Terms and Conditions govern the relations between ELKOMO OOD, hereinafter referred to as the "Merchant", and the customers of the Elkomo Shop online store, accessible via elkomo-shop.myshopify.com. By using the site and placing an order, the customer confirms that they have read these terms.

3. Products, prices and information

The main characteristics of the products are described on the respective product page. Prices are final for the customer and are indicated with VAT included, unless explicitly stated otherwise. Delivery costs are shown separately upon finalization of the order, where applicable.

The Merchant takes care to ensure that the information in the store is up-to-date. In case of a technical error in price, availability or description, the Merchant notifies the customer and offers confirmation of the corrected terms or cancellation of the order.

4. Order and acceptance

  • An order is placed by adding a selected product to the cart and filling in the delivery and payment details.
  • After sending the order, the customer receives an automatic confirmation that the request has been received.
  • The order is considered accepted after confirmation by the Merchant of availability, price, delivery and payment method.
  • The Merchant may request additional confirmation in case of incomplete data, special delivery, bulky goods or suspicion of abuse.

5. Payment

Available payment methods are shown at checkout and may include cash on delivery, card payment, bank transfer or other activated method. For bank transfers, the order may be processed after the amount has been credited to the Merchant's account.

6. Delivery

Delivery is made to the address specified by the customer or to a courier's office, when such an option is available. The delivery time and cost depend on availability, location, weight and volume of the shipment and are specified upon finalization or confirmation of the order. Unless another term is agreed upon, delivery is made within the legally permissible period of up to 30 days.

7. Right of withdrawal and return

For online purchases, the consumer has the right to withdraw from the contract within 14 days of receiving the goods, without stating a reason, except in cases provided for by law. To exercise the right of withdrawal, the customer must send a clear written statement to the Merchant before the deadline expires.

The returned goods must be sent without undue delay and no later than 14 days from the declaration of withdrawal. The costs of returning are borne by the customer, unless the Merchant has explicitly stated otherwise.

8. Complaints and legal warranty

All consumer goods are subject to a legal warranty of conformity in accordance with applicable law. The customer can submit a complaint in case of non-conformity or defect, by providing order details, a description of the problem and photos or other evidence, where applicable.

In case of a valid complaint, the Merchant takes action for repair, replacement, price reduction or refund of the amount in accordance with the law and the specific case.

9. Liability

The customer is responsible for accurately completing the delivery and contact details. The Merchant is not responsible for delay or inability to deliver caused by incorrect data, force majeure, actions of third parties or circumstances beyond the Merchant's reasonable control.

10. Personal data

Personal data is processed in accordance with the Privacy Policy published in the online store.

11. Changes to terms

The Merchant may amend these general terms and conditions in case of changes in activity, store functionalities or applicable legislation. For a specific order, the terms and conditions valid at the time of its submission apply.
